Don't bet on Prop 8 outcome

The Desert Sun warns against thinking that predictions of the court hearing on Prop 8 can be made from the questions and actions of the court members.
In the days after the state Supreme Court heard oral arguments on the validity of a gay marriage ban, supporters and opponents saw what they thought was the writing on the wall: the fight was over.

The tough questioning of the ban's opponents appeared to many that the court was leaning toward upholding Proposition 8, which defines marriage as between a man and woman.

But is it over?

Constitutional law experts say not just yet.

“It's very difficult to predict outcomes to Prop 8 on the basis of arguments,” said David B. Cruz, a University of Southern California law professor and constitutional law expert.

LGBT all over the world, always, and I mean always, are glad for a break, a nice surprise, a healthy nod or a well-deserved and hearty embrace.

Aren't we all even us straight?

I wish I could give IT and BP and others a hearty embrace but they'll have to settle for a virtual one.

Remember also those in Nigeria, Uganda, Jamaica, and elsewhere who would like what has already been gained in California in the last 40 years.

And if the court overturns it, more activist judge accusations, recall attempts, etc etc. At some level the onlly way to do this is via the legislature and the ballot box, not through the judiciary.

Don't get me wrong, I'd be happier if Prop8 were overtunred, but either way it's a viper's nest.
